Terms of service

These Terms of Service govern your use of the products and services provided by Zendrian Asia Limited, a Hong Kong company ("Zendrian," "we," "us," or "our"), including our software-as-a-service offerings, custom software development, APIs, websites, and applications.

Acceptance of terms

By accessing, using, or connecting to our services, you agree to these Terms and all incorporated policies. If you use our services on behalf of a company, you represent that you have authority to bind that company.

Use of services

• You must comply with applicable laws and avoid harmful, infringing, or illegal content or activity.
• We may suspend, limit, or terminate access at our discretion, with or without notice.
• We have no duty to host or continue hosting your content and may delete or disable it, including for unpaid balances or risk management.

Your content and license to us

• You retain ownership of content you submit. By submitting, posting, publishing, or transmitting content, you grant Zendrian a worldwide, non-exclusive, transferable, sublicensable license to use, process, store, reproduce, adapt, publish, display, and distribute it as instructed at the time of submission.
• Where content is published through our services, it may not be recallable once distributed.
• You warrant you have all rights to grant this license and that your content does not violate law or third-party rights.

Data, privacy, and tracking

• We collect and process data to operate, secure, and improve our services, including using tracking pixels, analytics, and related technologies consistent with industry standards across our apps and sites.
• We work with technology partners including ByteDance, Google, Meta, Microsoft, and others as needed to provide functionality, analytics, advertising, and integrations.
• We retain data as required for legal, regulatory, tax, security, and operational purposes. When legally permissible, we will delete personal data upon receiving a formal written request sent to the address in the Contact section; we may retain data where law requires or for legitimate business purposes such as dispute resolution and fraud prevention.

Payments and fees

• Charges are due on the schedule stated in your order, contract, or account. Late or unpaid amounts may result in suspension or deletion of access or content.
• You authorize us to charge the payment method on file for current and outstanding fees, taxes, and charges.
• All fees are non-refundable unless the charge was our mistake.

Service changes and availability

• We may modify or discontinue features or services. Material changes to these Terms will be posted with an updated effective date.
• Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation.

Third-party services and APIs

• Integrations with third-party platforms (including ByteDance, Google, Meta, Microsoft, and others) are subject to their terms and policies. You are responsible for complying with those terms.
• API use is subject to rate limits, security controls, and any additional terms we provide. We may revoke keys or access for abuse or risk.

Zendrian-Postiz — Terms of Use

These terms apply specifically to your use of Zendrian-Postiz, a social media content scheduling and publishing platform operated by Zendrian.

By connecting your TikTok account to Zendrian-Postiz, you authorize our application to publish video content to your TikTok profile on your behalf using TikTok's Content Posting API (Direct Post).

You are solely responsible for all content published through Zendrian-Postiz to TikTok. By using Zendrian-Postiz, you represent that:

• You own or have the necessary rights to all content you submit for publishing
• Your content does not violate TikTok's Terms of Service or Community Guidelines
• Your content is original and you are not using Zendrian-Postiz to copy content arbitrarily from other platforms to TikTok
• You will not submit content containing illegal material, adult content, or content that harasses or harms others

Zendrian-Postiz does not add watermarks, branding, logos, or promotional content to any material published to TikTok on your behalf.

You may disconnect your TikTok account from Zendrian-Postiz at any time.

Disclaimers and liability

• To the maximum extent permitted by law, Zendrian disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• Zendrian is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability is limited to the fees you paid to Zendrian for the service that gave rise to the claim in the twelve (12) months before the event.

Indemnity

You will defend and indemnify Zendrian and its officers, directors, employees, and agents from claims, damages, liabilities, and costs arising from your content, your use of the services, or your breach of these Terms.

Termination

• You may stop using the services at any time. We may suspend or terminate access for any reason. Certain provisions (including payment obligations, licenses granted, disclaimers, limitations of liability, indemnities, and governing law) survive termination.

Governing law and venue

These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them are governed by the laws of Hong Kong. The courts of Hong Kong have exclusive jurisdiction.
